Cette formalit\u00e9 administrative s\u2019impose pour laisser \u00e0 la commune la priorit\u00e9 pour l\u2019acquisition d\u2019un bien.<\/em><\/p>\n\n\n<div class=\"cta-wrapper\">\n    <a class=\"cta-custom\" href=\"\/simulation-projet\">Simulez votre projet<\/a>\n<\/div>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quel est le r\u00f4le de la d\u00e9claration d\u2019intention d\u2019ali\u00e9ner ?<\/h2>\n\n\n\n<p>Les communes ou collectivit\u00e9s locales d\u00e9terminent une zone pr\u00e9cise pour laquelle elles souhaitent exercer leur droit de pr\u00e9emption. Cette d\u00e9cision la rend prioritaire pour l\u2019achat d\u2019un bien afin d\u2019y r\u00e9aliser des projets d\u2019int\u00e9r\u00eat commun.<\/p>\n\n\n\n<p>En transmettant une DIA \u00e0 la mairie, le propri\u00e9taire indique que son bien situ\u00e9 dans le p\u00e9rim\u00e8tre choisi va faire l&rsquo;objet d&rsquo;une prochaine vente. Gr\u00e2ce \u00e0 cette information, la commune peut utiliser <a href=\"http:\/\/13.38.28.60\/2020\/09\/24\/terrain-constructible-et-droit-de-preemption\">son droit de pr\u00e9emption<\/a>. Cela stoppe ainsi l\u2019acheteur malgr\u00e9 la signature d&rsquo;un  <a href=\"http:\/\/13.38.28.60\/2020\/04\/18\/la-promesse-de-vente\">avant-contrat<\/a>. La collectivit\u00e9 locale poss\u00e8de en effet la priorit\u00e9 pour cette vente.<\/p>\n\n\n\n<p>Pour respecter la r\u00e9glementation en vigueur, le vendeur doit lui permettre de se substituer au vendeur. Il convient donc de l\u2019informer au plus vite que cette proc\u00e9dure de vente commence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qui doit transmettre la DIA ?<\/h2>\n\n\n\n<p>Le propri\u00e9taire doit se charger de cette d\u00e9marche. Toutefois, il devra passer par un notaire. Lorsque le vendeur a trouv\u00e9 un acqu\u00e9reur et qu\u2019il a sign\u00e9 une promesse de vente, l\u2019officier public se charge d\u2019informer la commune de la proc\u00e9dure. Pour faciliter cette d\u00e9claration, il existe un formulaire Cerfa. Il sera donc d\u00fbment rempli et accompagn\u00e9 des pi\u00e8ces justificatives n\u00e9cessaires. Cette d\u00e9marche repr\u00e9sente une offre de vente formelle r\u00e9alis\u00e9e aupr\u00e8s de la commune.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La d\u00e9claration d\u2019intention d\u2019ali\u00e9ner : une d\u00e9marche obligatoire<\/h2>\n\n\n\n<p>Une vente immobili\u00e8re r\u00e9alis\u00e9e sans le respect du droit de pr\u00e9emption de la commune peut faire l&rsquo;objet d&rsquo;une annulation. L\u2019envoi de la DIA s\u2019impose donc d\u00e8s lors que le bien se trouve dans une zone soumise \u00e0 ce droit. De cette fa\u00e7on, le vendeur anticipe cette issue.<\/p>\n\n\n\n<p>Avant de mettre son bien en vente, un propri\u00e9taire peut v\u00e9rifier si son bien se situe dans un p\u00e9rim\u00e8tre soumis au droit de pr\u00e9emption. Il peut ainsi pr\u00e9parer cette d\u00e9marche. Lorsque son bien n\u2019est pas concern\u00e9, la vente pourra se faire sans attendre.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le droit de pr\u00e9emption comme condition suspensive<\/h2>\n\n\n\n<p>Lorsque le bien mis en vente se situe effectivement dans une zone de pr\u00e9emption, l\u2019avant-contrat entre les deux parties poss\u00e8de une condition suspensive particuli\u00e8re. Ce document mentionne en effet que la vente est possible \u00e0 condition que la collectivit\u00e9 locale ne souhaite pas exercer son droit.<\/p>\n\n\n\n<p>Cette pr\u00e9cision est indispensable pour informer l\u2019acheteur que la vente peut \u00eatre annul\u00e9e si le droit de pr\u00e9emption est en effet appliqu\u00e9. Le vendeur de son c\u00f4t\u00e9 est prot\u00e9g\u00e9 par cette condition suspensive. Aucune indemnit\u00e9 ne sera vers\u00e9e \u00e0 l\u2019autre partie en cas d\u2019annulation effective.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">L\u2019obtention de la r\u00e9ponse \u00e0 une DIA<\/h2>\n\n\n\n<p>Une fois que cette d\u00e9claration d\u2019intention d\u2019ali\u00e9ner a \u00e9t\u00e9 transmise, la proc\u00e9dure de vente ne peut reprendre que lorsque la r\u00e9ponse est re\u00e7ue. Le notaire ne pourra faire signer le contrat authentique de vente avant de conna\u00eetre les intentions de la commune ou collectivit\u00e9 locale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Une r\u00e9ponse tacite suite \u00e0 une DIA<\/h3>\n\n\n\n<p>Apr\u00e8s un d\u00e9lai de deux mois apr\u00e8s l\u2019envoi de la d\u00e9claration d\u2019intention d\u2019ali\u00e9ner et sans r\u00e9ponse de sa part, la loi indique que son silence vaut renonciation. Le notaire peut alors finaliser la vente en faisant signer le contrat d\u00e9finitif de vente entre les deux parties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">La r\u00e9ponse expresse de la collectivit\u00e9 locale<\/h3>\n\n\n\n<p>En g\u00e9n\u00e9ral, la commune sollicit\u00e9e est r\u00e9active. Avant la fin du d\u00e9lai de deux mois, elle va donc indiquer son intention de renoncer \u00e0 son droit de pr\u00e9emption ou au contraire son souhait d\u2019acheter le bien.<\/p>\n\n\n\n<p>Lorsqu\u2019elle d\u00e9cide de renoncer, ce refus est d\u00e9finitif. Le vendeur peut donc c\u00e9der son bien \u00e0 son acheteur. Elle ne pourra pas le r\u00e9clamer par la suite.<\/p>\n\n\n\n<p>Par contre, si la collectivit\u00e9 locale d\u00e9cide d\u2019utiliser son droit de pr\u00e9emption, elle doit le signaler au plus vite, avant la fin du d\u00e9lai de deux mois pr\u00e9vus par la loi.<\/p>\n\n\n\n<p><strong>City&amp;You accompagne les propri\u00e9taires souhaitant vendre leur bien \u00e0 un promoteur immobilier, un investisseur ou un lotisseur.
