Que contient-elle exactement ? Quel est son champ d\u2019application pr\u00e9cis ? Voici une pr\u00e9sentation compl\u00e8te du PUP.&nbsp;<\/em><\/p>\n\n\n<div class=\"cta-wrapper\">\n    <a class=\"cta-custom\" href=\"\/simulation-projet\">Simulez votre projet<\/a>\n<\/div>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le cadre et le champ d\u2019application du projet urbain partenarial (PUP)<\/h2>\n\n\n\n<p>Le projet urbain partenarial ou PUP est un outil de financement pour des op\u00e9rations d\u2019am\u00e9nagement. Il fait partie de la famille des outils de l\u2019am\u00e9nagement et accompagne les collectivit\u00e9s pour faire \u00e9voluer leur territoire.&nbsp;<\/p>\n\n\n\n<p><strong>Plus concr\u00e8tement, il s\u2019agit d\u2019un contrat qu\u2019une collectivit\u00e9 comp\u00e9tente en urbanisme n\u00e9gocie avec un op\u00e9rateur foncier afin de lui faire financer une partie des \u00e9quipements n\u00e9cessaires \u00e0 l\u2019op\u00e9ration d\u2019am\u00e9nagement<\/strong>. En clair, s&rsquo;il s&rsquo;agit d&rsquo;un nouvel ensemble collectif, des infrastructures (routes, r\u00e9seaux d\u2019eau et d\u2019\u00e9lectricit\u00e9) ou des superstructures (\u00e9coles, gymnases) peuvent \u00eatre n\u00e9cessaires. Le PUP vise \u00e0 identifier les besoins et \u00e0 faire contribuer les initiateurs du projet de construction. En retour, ces derniers obtiennent une exon\u00e9ration de la taxe d\u2019am\u00e9nagement (TA).<\/p>\n\n\n\n<p>Deux cat\u00e9gories de PUP cohabitent.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le PUP \u00e0 convention unique, qui permet de satisfaire les besoins en \u00e9quipements publics d\u2019une seule op\u00e9ration. C\u2019est le cas par exemple lorsqu\u2019un promoteur immobilier souhaite r\u00e9aliser un programme ;&nbsp;<\/li>\n\n\n\n<li>La zone de PUP, qui permet alors de r\u00e9pondre aux besoins en \u00e9quipements publics de plusieurs op\u00e9rations. Le contrat lie dans ce cas plusieurs parties (am\u00e9nageurs, constructeurs ou propri\u00e9taires).<\/li>\n<\/ul>\n\n\n\n<p>Le PUP peut s&rsquo;appliquer sur les zones \u00ab urbanis\u00e9es \u00bb (U) et \u00ab \u00e0 urbaniser \u00bb (AU) du plan local d\u2019urbanisme (PLU), mais aussi \u00e0 d\u2019autres <a href=\"http:\/\/13.38.28.60\/2021\/01\/21\/zonage-votre-terrain-est-il-constructible\">zonages<\/a>, au cas par cas. Il est toutefois n\u00e9cessaire que le territoire concern\u00e9 soit couvert par un PLU ou un autre document de r\u00e9f\u00e9rence mais pas une simple carte communale.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ce que contient le PUP<\/h2>\n\n\n\n<p>Les autorit\u00e9s publiques comp\u00e9tentes ainsi que le partenaire priv\u00e9 qui initie un projet de construction doivent n\u00e9gocier les conditions et le contenu de la convention du PUP.&nbsp;<\/p>\n\n\n\n<p>Les op\u00e9rations de construction envisag\u00e9es doivent y \u00eatre d\u00e9taill\u00e9es avec un calendrier pr\u00e9cis. Celui-ci peut s\u2019appuyer sur le planning de construction de l\u2019op\u00e9rateur priv\u00e9 afin que les \u00e9quipements publics r\u00e9pondent de mani\u00e8re progressive aux diff\u00e9rentes phases de construction. Pour chaque \u00e9l\u00e9ment, un co\u00fbt pr\u00e9visionnel doit aussi \u00eatre pr\u00e9cis\u00e9.<\/p>\n\n\n\n<p>Il faut \u00e9galement d\u00e9tailler la forme de la participation de l\u2019op\u00e9rateur priv\u00e9. Elle peut \u00eatre financi\u00e8re avec un montant d\u00e9fini. Elle peut \u00e9galement prendre d\u2019autres formes, avec l\u2019apport de terrains b\u00e2tis ou non.<\/p>\n\n\n\n<p>Enfin, puisque le projet urbain partenarial permet d\u2019aboutir \u00e0 une exon\u00e9ration de taxe d\u2019am\u00e9nagement, des informations \u00e0 son sujet doivent \u00e9galement figurer dans la convention. On doit y retrouver le p\u00e9rim\u00e8tre couvert par la convention (c\u2019est-\u00e0-dire le p\u00e9rim\u00e8tre concern\u00e9 par l\u2019exon\u00e9ration) mais aussi la dur\u00e9e d\u2019application de l\u2019exemption.
